The Second Amendment insures that this will not happen...
Something tells me that you probably would like to repeal that one though.

This is already happening now with Judges being the "private power".

Not only judges, but politicians also, who are the people who influence the appointments or appoint a lot of our judges. John makes a good point about rogue judges having too much power. However, I see the "private power" being the control of our money supply by a central bank. Although the Fed gets authority from Congress, it's decisions are made independently. It is an ultra powerful fourth branch of government.
