U.S. Cites Exception in Torture Ban
McCain Law May Not Apply to Cuba Prison
By Josh White and Carol D. Leonnig
Washington Post Staff Writers
Friday, March 3, 2006; A04
Bush administration lawyers, fighting a claim of torture by a Guantanamo Bay detainee, yesterday argued that the new law that bans cruel, inhuman or degrading treatment of detainees in U.S. custody does not apply to people held at the military prison.
In federal court yesterday and in legal filings, Justice Department lawyers contended that a detainee at Guantanamo Bay, Cuba, cannot use legislation drafted by Sen. John McCain (R-Ariz.) to challenge treatment that the detainee's lawyers described as "systematic torture."
Government lawyers have argued that another portion of that same law, the Detainee Treatment Act of 2005, removes general access to U.S. courts for all Guantanamo Bay captives. Therefore, they said, Mohammed Bawazir, a Yemeni national held since May 2002, cannot claim protection under the anti-torture provisions.
So..that signing statment from Bush...it meant that anything goes on Gitmo. No laws, no restrains... You Republicans have gotta be freaking proud of that administration you forced on the rest of us..
Words ...I have no civil words for the disgust I feel toward this administration. Maybe I'll find some good ones later.
As for you Bush backers....thanks...thanks alot.
I'll bet this wasn't what Sen McCain had in mind when he authored the anti torture bill.

The fine art of debating has just evolved. Anonymous posts with no immediate face-to-face feedback is a much different environment than the traditional debating forum. The debates that survive in this new environment are the ones with the most posts. And, thanks to the provocative initial post, the concise acknowledgment, and the Newton's third law rant and reaction, this thread is well on it’s way to surviving, perhaps prospering. And threads that prosper spawn more children than their competitors. Soon the forum is dominated by these types of debates. This is pure natural selection. Explain THAT, intelligent design.

I agree with Monkey. These debating issues turn into such harsh arguments. It raises the blood pressure to a level I choose not to explore. Boring definately does not fit this situation in any way, shape or form.

All I keep thinking is how would Jack Bauer ever save the country if pansy desk-jockeys are allowed to tie his hands. I mean this is a perfect example of how people in this country turn the other way when it comes to the hard decisions it takes to run a country. I for one am happy to stick my head in sand when its time to wipe out another country so I can simutaneously drive my three hummers and heat my 4500 sqft house. I mean jeez. What kind of world do you want to live in! One where we actually have to live in a one of those icky third world places?
By the way, from what I know about intelligent design, people who don't agree with what's here and now are prime examples of natural selection.

Ok,it the order they were posted.
But first, HEY finally there is a topic in politics again. Did ya miss me? Yeah...screw that.
Tocools, I was made god (with a little g) the day that moron was elected and and someone needed to tell you what they were doing. We sure couldn't rely on the "liberal" press to do it. So I became a news god and told you the truth that hurts. Now say ouch and get on with your life. Your little republican life.
And Terry....have a great morning. http://oakhurstonline.com/icon/laugh.gif
YJ. Tocools knows I'm right. Hes just to proud to admit it.
Monkey, Public debate is alive and well, I just started another one, didn't I? Its nice to have anything new in the politics forum, None of ya'll discuss the topics otherwise. I don't mine Tocools.....we are friends that disagree about things. So please enter in with your thoughts.
Jocobscalpel, you are more right than you know. Debate DID just evolve again> And you are absolutely right about the postsing numbers and the environment. Note the number of views and responses.
Nascar, put your tongue in your cheek, toss a grain of salt, and read the whole thing again. I wasn't intending to bore anyone, just provoke.
While I am upset about the administration defying immorality of torture, people at least read the post and responded to something. If Tocools hadn't responded to my post...no one would have said anything.
Candyappleisland, your sarcasim is dually noted. And appreciated. Now fire up those Hummers, and go to a save the whales rally.

the democrats are just as bad as the republicans. why do you take stock in either party? The Liberals/Democrats/aka Clinton are just as conservative and anti people as the republicans. The democrats are just as pro money and anti regular ppl as the money grubbing republicans. So lets all get off of our damn high horses and settle down. It is really really embarrassing to see ppl chew each other out here and call each other names. No wonder some ppl here do not want to meet ppl from the board.

So much has changed in my life in the past month. It's kind of nice to see that some things don't change. http://oakhurstonline.com/icon/lol.gif
Now I have a home in Republican land and Liberal land. http://oakhurstonline.com/icon/rofl5.gif I have many friends that disagree with my political opinions. I like diversity in my friends and I like to debate. Politics will not get in the way of any of my friendships. I have mostly stayed out of the debate here, however, since I have to be the Admin that tells you all to chill out when you start name calling.
But I'll say it once for those that don't know... I agree a lot with Coldwolf when it comes to politics. I'm not saying that I agree with everything... but MOST.
I really do think that Bush is going to go down in the history books as the worst President in history. I know that a lot of you on the forums here do not agree with me and that's fine. Time will tell. http://oakhurstonline.com/icon/wink3.gif
And no, I'm not a democrat. I'm a free thinker. I think for myself, not what my party tells me to think. In fact, I am registered as Independant. It's amazing to me to see how many people support their political party even when things are so obviously wrong. Just like some people will never admit fault in themselves, they do not see fault in those they support. Some people don't want to think for themselves. They want others to do the thinking for them.
Yeah I know... I'm asking for it. Go ahead and bash me now. http://oakhurstonline.com/icon/lol.gif I can take it... and I wont even start calling you names. http://oakhurstonline.com/icon/wink3.gif

I intended this thread to rile people up. It worked. And ToCools, for all his more to the right of me views will probably agree with me on this.
Not on the topic of the thread, but on this post.
We all say chit like mess did..same chit different day...
The Idea was to start a topic, a conversaton, a debate. It worked. ToCools responded like I knew he would, jumped down my throat. So what? Some of you read and responded and that was good. Thats what a forum is about.
Is it the same chit, different day?
Probably.
Do you think its OK that the American government is condoning torture and inhumane treatment of prisoners that it has held for nearly 3 years? You can admit it. Go ahead.
The topic alone was intended to rile you up. I called the administration of the BUSHIES jerks. And blamed you for them. Isn't that true though?
The Democrats didn't elect them. They only represent ..well to make the math easy, 50%+ a spit. Thats all it took, right? And 50%- a spit aren't represented by them. And since the Repugs control the House and the Senate and now the Supremes...that half of the county isn't really represented at all.
The Democratic Party is in a position to make a move...but they won't.
Why?
because YJ is right. They have a couple of differences, but primaraly represent the interest of big business. And you want to know why?
Its because thats where the money is. Not tax money..who gives a flying freak about that? Tax money won't even pay the bills of the country. Chit, thats why we have a 8 trillion dollar deficit in 6 years. Because taxes don't cover the needs of the nation.
No, it because there are billions of dollars floating around to give politician their cushy jobs and their hidden fortunes. The re-election monies. The fun little trips Abramoff sent the Republican pols on. He got caught. And a bunch of republicans got caught too. I'm not so nieve to think there aren't Democrats on the take. Even if its all legal, the re-election money is the same chit.
Hell, the Democrats don't represent me. They represent the businesses paying their bills. And the Republicans don't represent John, or Messy ,or ToCools...The politicians don't know me, or you, or anyone that hasn't given them either money or an opportunity to put their face in a photo, or a sound bite.
All we can ever hope for anymore is the opportunity to put some junior Representitive in, who cares enough to represent his or her home and nieghbors for a couple of years until the businesses sink their hooks of greed into them.
Yeah, I'm bitter about the political scene.
I won't stop pointing out the things I see that are disturbing, and right now it the Republicans I see being the most disturbing.

Cool OlderWolf... good to see ya wolfspit on the Dems too. I think Sandman said it best when he called self a independent thinker. Its when ppl forget to think outside the box and just vote "dem" or "republican". that gets us into trouble.
Both parties suck cocktail weenies and need some good shaking. If more ppl would vote their minds and not with their cocktail weenies.. we might get a decent government one day.
Vote Libertarian... Vote Independent... just dont vote inside the box!

Mar 05, 2006, 06:32 AM
I didnt vote for Bush this round. I did the first time though. I didn't care for anyone running for Pres. this term. I didnt' vote for a Pres this term.
I just have a big problem with the name calling and getting slammed because you don't agree.
I've always said the "big businesses" run this country.
What bothers me is your so up in arms about the prisners being tortured.
What bothers me is innocent civilians like a 10 year old girl being kidnapped out of her bed while she's sleeping. raped, tortured and murdered.
What bothers me is child molesters and rapists getting 30 days in jail.
Sorry my focus isn't on pow's being tortured its our own children that bothers me.
Dodgergirl
Mar 05, 2006, 07:12 AM
Honestly, I have a problem with...
1. The government (and there's a lot of problems there)
2. Children being abused in any way (Most of you know children are my focus in life)
3. Human beings being tortured (ANY Human)

I'm going with Messy and Dodge on this one. I spend a lot of time just reading these posts and wishing that this much energy would be spent locally. Hell, I'd be happy if we found a way to channel all this debate into limiting how many freakin' Starbucks we get built here. http://oakhurstonline.com/icon/shout.gif
Coldwolf
Mar 05, 2006, 01:46 PM
I'm going to reply to Messy first, because her points should be addressed well.
I wish you had voted for someone for President. I can't. Because of...shall we say, "youthful indescresions" I haven't been able to vote since the late eighties. I have not vote. So when I hear about people that can vote, and don't it bothers me. Because I want to.
The getting slammed for disagreeing. Well..remember when I got upset about the http://oakhurstonline.com/icon/rolleyes2.gif and the tinfoil hat comments? That was getting slammed to, wasn't it? Its one thing to disagree, and be able to say why, its another thing to just be rude, and not state any point of view other than calling a person a dumbasz or idiot. I think I have always backed up my point of view with reason and information to a pretty good degree.
Messy:I've always said the "big businesses" run this country.
I say the same thing, and I think the people have to revolt against this system and take the government back. I'm not talking insurrection, I'm talking about only electing representitives that have no ties to business. And if an administration tries to appoint a person to a position in an agency, he should not have ties to the businesses that will profit from his appointment.
It bothers you that I am up in arms about prisioners being tortured. Well, it bothers me that you aren't. We are Americans. We don't do those things.
My GOD Messy, do you think anyone on the left thinks kidnapping a child, raping and killing her is good? Do you think any sane person condones that? And molesters and rapists getting 30 days in jail...Honestly. Do you think I feel any differently than you on that?
Yosemite Joy
Mar 05, 2006, 06:59 PM
So Messy didn't vote for a President because she didn't like any of the candidates. And because who cares about POW's (but ARE they POW's? That would make them free from torture... oh wait. Getting too technical here) because children are being raped.
If I drive a Suburban instead of a minivan does that make me Republican?
Another thing, what about Darfur? And now Chad? No one here reads the New York Times? Hey you can get one for a buck when you get your Latte at one of the "many freakin' Starbucks" we have here. I will buy it for you, if you promise to read the articles and not just look at the pictures.
I wish that I lived in a Liberal town like Sandman does. If it were an option... but today it isn't. Someday I will go back to Vermont where I belong. For now, I just grin when I see a "**** BUSH" sticker on some guys hybrid on the Bay Bridge on my way home.
It feels good to be around people who read something other than Glamour (though I read that every month) and the Washington Times (ok that was a joke, I know you don't read the Wash Times).
Pass the salt.

Okay...maybe I should have referred to it as one of the "TOO many ******* Starbucks" we have around here, and you would have understood that I don't buy lattes there.
I'm pretty sure that everyone on here reads, so promising that we will read the articles shouldn't be too difficult. The only thing I just look at the pictures in would be Playgirl.

Again I didn't vote for Pres. because I didn't like any of the candidates. Thats my option.
You are passionate about politics. I never ever said you didnt care about children being kidnapped, raped and tortured. What I said was thats my passion.
Your posts are mostly about politics which is fine.
What in the hell makes you think I don't read whats going on in this world. I do. However there are somethings I dont wish to post my view on in this forum because I know whats going to happen.
I also "watch" my news in the morning and not local TV stations. I do not mute the volumn and look at the pics. The volumn is up beleave me.
Our tolerence is why we have so much crime in this country. For example the Cali. law on execution. "don't hurt the poor man that brutally tortured his victim" is a bunch of BS.
Coldwolf there are something things I do not buy because of who makes it or where it comes from. For example gas.
I do not read or look at pics in fashion or gossip magazines.

Kim, I wasn't serious about the Lattes. Though I do like a latte once in awhile. Vanilla ones. I pretty much stick to tea lately for obvious reasons.
What is wrong with fashion magazines?
What do you guys do for your "passions"? (that should be a new subject I guess)
And who wants National ID cards? And what about Sudan, or Chad? What about real issues? Politics are fun once in a while, but damn there are more important things. Like, if I buy a Suburban and put Impeach Bush stickers on it, does that make me a hypotcrite? They don't make hybrid Suburbans, and minivans (for mini people) just not my thing. Wait! When the hell did I start caring what people think?

Fashion and gossip mags are not my thing. My friends get a kick out of me cause "Coastal Living" is one of my fav. mags. I also like "Western Homes"

BTW, If any of you are watching season 2, PLEASE PLEASE PLEASE make no references to it in this thread. We're watching the show via DVD and are always 9 months behind both "24" and Lost. thanks!

Hey, I think you have the characters down pat pretty good - except - I can't see Sandman as Sayid. Maybe John @ 3300 ft. would be better. I think Yosemite Wolf would make a good Ana Lucia and Dodgergirl would do good as Kate. Sandman could be Jack. As for me I would make an excellent Director!
Good suggestions. I think you're right on.

I hear that! I do the same thing. Except I watched all of the first Lost season, then started watching the tv on wednesday now. I have Tivo and record it. Commercials suck.
Did the same thing with SATC, and CSI. Going to watch House next on DVD, ever seen it? Terrific! Watched an episode at a friend's house a couple weeks ago. House is the type of asshole I wish I were.

What's weird to me is the guy who plays Dr. House is the same guy who plays the father on Stuart Little...I have a hard time watching him act like an "a$$hole" (that's what Yosemite Joy called him!).

Lost is a show that comes on Wed. at 9pm.
This plane crashes on this island with these characters as the survivors.
There have been I think 2 or 3 main characters that have died.
Lost is one of my favorite shows.
YJ's avatar is Claire.
Jacob's avatar is Sawyer on the show ...and oh boy I'm starting to drool.
I love watching Sawyer.

How funny I've never me Jacob, and I just saw his avatar, and thought, "Boy, he is sure cute", thinking it was a photo of Jacob. http://oakhurstonline.com/icon/laugh.gif I don't watch Lost, but maybe I'll have to.

Yeah, unfortunately for me I look nothing like Sawyer. Hell, even I think he's cute. Lost is a great show too. Rent the first season on DVD, then start watching. You won't regret it.

CIA LEAK STORY (http://news.yahoo.com/s/ap/20060406/ap_on_go_pr_wh/cia_leak_5)
It's not clear whether Bush did or didn't authorize Libby to leak Valerie Plame's name, but now we now know that Bush himself is a leaker - Bush thinks leaks of classified information are a-okay and a worthwhile and acceptable tool of politics.
And Bush himself is directly responsible for leaking classified information to - who? - why REPORTERS! The very people who Bush now has the Justice Department investigating for receiving leaks of classified information regarding secret CIA prisons in Eastern Europe.
So, Bush authorized leaks of classified information to reporters, yet he's investigating people in his administration for leaking classified information to reporters. It's good to be king.
You might remember that Bush leaked classified information to Bob Woodward for one of Woodward's books. The issue was raised at the time, but no one in the media or the Hill wanted to seriously go after it because Bush was still Big Brother back then. Hopefully they'll start going after the leaker-in-chief now.
Vice President Dick Cheney's former top aide told prosecutors President Bush authorized the leak of sensitive intelligence information about Iraq, according to court papers filed by prosecutors in the CIA leak case.
Before his indictment, I. Lewis Libby testified to the grand jury investigating the CIA leak that Cheney told him to pass on information and that it was Bush who authorized the disclosure, the court papers say. According to the documents, the authorization led to the July 8, 2003, conversation between Libby and New York Times reporter Judith Miller.
There was no indication in the filing that either Bush or Cheney authorized Libby to disclose Valerie Plame's CIA identity.
But the disclosure in documents filed Wednesday means that the president and the vice president put Libby in play as a secret provider of information to reporters about prewar intelligence on Iraq.
